03.21.2013 The Senate Medical Affairs committee gave this bill a favorable report with amendments. The amendments provide protection for counties that have issued bonds related to development of landfills and states that this legislation in no way hinders the local government’s ability to determine through zoning where landfills are located and does not change the local government’s ability to refuse waste from outside its jurisdiction. The amendment also requires that a covered material process facility must submit a report to DHEC and must prove financial responsibility. 02.13.2013 A Senate Medical Affairs subcommittee gave this bill a favorable report with an amendment. The amendment strikes all of the language in the bill and replaces it the language from S203. S203 prohibits counties from restricting the flow of waste coming into or leaving the county.01.22.2013 The House Agriculture, Natural Resources and Environmental Affairs committee gave this bill a favorable report with an amendment. Summary of the bill as introduced: Imposes a moratorium in effect until December 31, 2017, on DHEC issuing permits to construct certain new Class 3 landfills or to replace or expand certain existing Class 3 landfills. The resolution also prevents DHEC from issuing approvals to increase the annual disposal rate at certain Class 3 landfills.
